Operating costs are to be settled annually if advance payments have been agreed.

The utility bill must contain at least the following information in accordance with current legislation:

a summary of the total cost of the entire property to be billed for;
the specification and explanation of the underlying distribution keys;
the calculation of the proportion of the rented dwelling which the tenant is to bear (for each type of operating cost);
the deduction of the advance payments of the renter.

A statement that does not meet these requirements is already formally invalid and will therefore not be due. In the worst case, this can mean that subsequent claims are no longer possible. The Federal Court of Justice has ruled that deviations in area information do not necessarily lead to a formally incorrect utility bill.

Vacant units must be included in the apportionment. The costs of vacant units are borne by the owner. For the allocation of heating costs and hot water, the heating cost regulation applies.
