The operational responsibility can be delegated in such a way that the responsibility of the operator is at least partially transferred to the delegate recipient, ie the delegate can exculpate himself in case of a damage occurrence.
The effective delegation is subject to strict conditions, otherwise the operator responsibility remains with the delegate. This applies not only to a delegation to a third party, but also to the internal delegation in your own company. Against this background, the delegation must be systematically organized and monitored, including under contract law.
